(AP) ? European Central Bank president Mario Draghi has already taken Europe's monetary authority into uncharted territory.

Now, with the debt crisis in Europe threatening further disaster, he may have to push it even farther into the unknown to save the euro.

The 17 countries that use the euro are struggling as economies across the region face deepening recessions. Spain and Italy, the two chief trouble spots, are threatened with a financial collapse that could tear the 13-year old currency union apart and rock the global economy.

Spain's bond borrowing costs, or yields, have hit record highs recently as it tries to prop up its stricken banking sector and meet requests for financial aid from its regional governments. That has raised fears the country may be the next to seek a bailout from the other eurozone countries, following Ireland, Greece, Portugal and Cyprus. Italy, attempting to keep a handle on its debts in a stagnant economy, is also feeling the heat.

Then last Thursday, Draghi sharply raised expectations for more central bank action when he vowed the ECB would do "whatever it takes" to save the 17-country euro, and that "believe me, it will be enough." Markets jumped on the news, expecting that the bank could soon intervene in bond markets to drive down the borrowing costs that are threatening Spain and Italy.

In the days following Draghi's comments, politicians across Europe have added their voices to pledges of action for the eurozone. First came a joint statement from Angela Merkel of Germany and France's Francois Hollande, followed by another from Merkel and Italy's Mario Monti. This was followed by the head of the eurozone's finance ministers group, Jean-Claude Juncker, and German finance minister Wolfgang Schaeuble.

All eyes are on Draghi to see what the ECB can deliver.

Yet Draghi and the 23-member governing council face a key constraint: they must contend with the demands of fear-stricken financial markets on one side and its founding treaty on the other.

The 1992 treaty gives the bank an overriding mandate to control inflation first, and only then to seek other goals such as growth. It is forbidden from supporting the finances of eurozone governments. That's different from other central banks, such as the U.S. Federal Reserve and the Bank of England, which have broader crisis-fighting powers.

The Fed is meeting this week and could decide to take more action to stimulate a weakening economy.

How far can Draghi go? The bank also has a meeting this week but could act at any time. Here are some possibilities ? and their drawbacks:

BUY GOVERNMENT BONDS:

Buying bonds drives up their prices, and pushes down their interest rates ? or yields. That's because prices and yields move in opposite directions. Starting in May, 2010, the ECB intermittently bought more than ?200 billion worth of bonds of shaky governments including Italy and Spain, on the open market.

DRAWBACK: The effort did not do much to calm the crisis. Its impact was blunted because the ECB stressed it was limited in amount and focused only on spreading the ECB's interest rate policy throughout the eurozone. It is opposed by some, including Germany's Bundesbank, which has a seat on the ECB's board, as blurring the bounds between influencing interest rates ? the ECB's job? and helping government finances, which it can't do.

Europe's temporary bailout fund, the European Financial Stability Facility, could buy bonds ? but has limited resources on its own.

TURNING THE BAILOUT FUND INTO A BANK:

By agreeing to a banking license for the European Stability Mechanism, the bailout fund set up by the countries that use the euro, the ECB would enable the fund to borrow from the ECB and use that money to buy the bonds of troubled governments from investors on the open market.

Because the ECB can create as much money as it wants in order to lend, the ESM could in theory raise several trillion euros if it had to. And because the ECB is not helping out governments directly, it can be argued the practice would not fall foul of the treaty.

"That is the No. 1 concrete thing they could do," said Karl Whelan, an economist at University College Dublin and former staff economist at the Federal Reserve. "There is nothing illegal about it. People would stop staying the eurozone doesn't have the firepower to fund Spain and Italy. It would be the end of that concern."

DRAWBACK: Nonetheless, Draghi and others say the idea is still too close to financing governments. He made a forceful statement July 5 that the move would violate the ECB's mandate and would mean violating its mandate, thus "destroying its credibility."

Still, the ECB has reversed course on other issues during the crisis.

LEND TO BANKS:

The ECB could expand its lending to banks for short-term loans. It would do that by agreeing to ease its rules on what types of collateral it could take for banks for these loans. It has already done this several times before and also given banks unlimited credit.

It could also make a third offer of cheap, three-year loans to banks, after two rounds that handed out ?1 trillion in December and February. Some banks used the money to buy government bonds. That's allowed under the ECB treaty because the ECB can loan any amount to banks ? just not to governments.

DRAWBACK: Banks holding too much government debt is already one of the key risk factors in the crisis. A government default would hurt banks and cut off lending to the wider economy. More lending could make that worse.

CUT RATES:

Analysts say the ECB has room to cut the main refinancing rate it charges banks for loans from the current all-time low of 0.75 percent. It could also push the rate it pays banks for deposits ? currently zero ? into negative territory, a move aimed at pushing them to lend funds rather than stash them with the ECB. This could help bolster currently weak growth ? which would help government tax revenues and make it easier to pay debts ? and lower costs to shaky banks.

DRAWBACK: Rates are already very low and it's not having much effect on business activity and borrowing.

Jonathan Loynes, chief European economist at Capital Economics in London, says Draghi's remarks last week were a "pretty strong signal" the bank might intervene in government bond markets with limited purchases aimed at lowering countries' borrowing costs, as it has before on a limited basis. Markets, however, appear to hope for that plus more, a comprehensive new approach.

"My guess is, the markets will be disappointed," Loynes said. "There was a lot of emphasis on those three words, 'Whatever it takes.' "But there are three other words that are just as important: 'Within our mandate.'"

Following the conclusion of proceedings in Bilski, the district court found the above claim, as well as corresponding method and media claims, as failing the Machine-or-Transformation test, because the steps could be performed manually and any computer recited in the claims was a mere general-purpose add-on. The district court did not engage in formal claim construction before invalidating all claims under ? 101, leading to the first issue on appeal ? is claim construction indispensable for summary judgment of invalidity under ? 101? No, it?s just recommended:

claim construction is not an inviolable prerequisite to a validity determination under ? 101. We note, however, that it will ordinarily be desirable?and often necessary?to resolve claim construction disputes prior to a ? 101 analysis, for the determination of patent eligibility re-quires a full understanding of the basic character of the claimed subject matter.

Because claim construction is a desirable component of a subject matter eligibility determination and a question of law, the panel decided to construe the claims itself in the first instance. The big question was whether method claims not reciting hardware nonetheless required a computer for their execution (the panel agreed the above-quoted system and media claims must be construed to include hardware under their plain language). For the method claims, despite the specification disclosing only computerized embodiments and the methods being highly inefficient to do by hand, the Federal Circuit relied on plain language and claim differentiation to construe the independent method claims to not require hardware, whereas dependent claims reciting the methods being ?performed by a computer? did require hardware.

Turning to the merits of patentable subject matter, the parties framed the debate as complex-computer-programming-limited-process-and-structure versus mathematical-formulas-with-computers-thrown-in antipodes. The panel saw the claims here as the patent-ineligible latter. The opinion really focused on the now familiar steps of 1) discerning an abstract idea in the claims and 2) ascertaining whether a sufficiently specific application of the idea was present. As for identifying the abstract idea, the court saw little difference between the claims here, reducible to managing a stable value protected life insurance policy, and the abstract idea of hedging energy market risk in Bilski:

Here, Bancorp?s patents ?attempt to patent the use of the abstract idea of [managing a stable value protected life insurance policy] and then instruct the use of well-known [calculations] to help establish some of the inputs into the equation.? Id. As in Bilski, the claims do not effect a transformation, and the fact that the required calculations could be performed more efficiently via a computer does not materially alter the patent eligibility of the claimed subject matter.

The panel further highlighted two indicia of insufficiently-limited abstractness emerging from Research Corp. and CyberSource: that the asserted patents did not describe how their methods improved on existing technology; and that the claimed financial method could be performed mentally or at least manually. Thus, the claims could be more easily analogized to CyberSource (invalid) than Research Corp. (not invalid):

the claimed processes in Research Corp. plainly represented improvements to computer technologies in the marketplace. For example, as compared to the prior art, the ?inventive mask produce[d] higher quality halftone images while using less processor power and memory space.? Id. at 865. No such technological advance is evident in the present invention. Rather, the claims merely employ computers to track, reconcile, and administer a life insurance policy with a stable value component?i.e., the computer simply performs more efficiently what could otherwise be accomplished manually. Bancorp, 771 F. Supp. 2d at 1065.

Second, the method in Research Corp., which required the manipulation of computer data structures (the pixels of a digital image and the mask) and the output of a modified computer data structure (the halftoned image), was dependent upon the computer components required to perform it. See CyberSource, 654 F.3d at 1376 (?[T]he method [in Research Corp.] could not, as a practical matter, be performed entirely in a human?s mind.?). Here, in contrast, the computer merely permits one to manage a stable value protected life insurance policy more efficiently than one could mentally. Using a computer to accelerate an ineligible mental process does not make that process patent-eligible.

Having found some ?abstractiness,? the panel looked at whether the computers recited in the system, media, and dependent method claims could confer subject matter eligibility by representing a specific application. They could not. Under SiRF, to ?salvage an otherwise patent-ineligible process, a computer must be integral to the claimed invention, facilitating the process in a way that a person making calculations or computations could not.? While Bancorp argued that computers were significant here by enabling the claimed precise and repetitive calculations, the court said ?[t]hat misses the point. It is the management of the life insurance policy that is ?integral to each of [Bancorp?s] claims at issue,? not the computer machinery that may be used to accomplish it.? The panel here also continued the CyberSource trend of treating system and computer readable media claims no differently from counterpart method claims that recite insufficient application on specially-configured computers.

The patentee also argued specific application was present here because the claims operated in the life insurance market and because the defendant had plead that their similar methods did not infringe, and thus were not preempted by, the claims at issue. The panel rejected both these arguments ? the first as a mere field of use limitation entitled to no ? 101 weight under Bilski and Flook, and the second as a mere artifact of alternative pleading.

Lastly, the opinion threw some support behind the majority in the recent CLS Bank v. Alice Corp., finding the facts there distinguishable. Particularly, the panel here (including the dissenter from CLS Bank) seemed to agree that the computer limitations there played a ?significant part? in the claimed method of a specific financial application. Here, however, the computer was just a facilitator to using an abstract concept. Invalidity of all claims affirmed.

Lessons: Where Bancorp Services provides the most ? 101 guidance, it is in its definition/detection of an abstract idea and treatment of computers as sufficient applications or a preemption avoiders. First, it?s undeniable from this case, CLS Bank, Dealertrack, Fort Props., and Bilski that anything approaching a business method/system/program is nowadays highly susceptible to a ? 101 attack. Panel after panel have had zero qualms with labeling a market or legal transaction as ?abstract.? Thus, at a minimum, carefully consider the facts and outcomes in these cases when drafting such applications ? and in determining if patent protection is even available to one?s innovation in these sectors. Second, Bancorp Services reemphasizes past recommendations for avoiding abstractness to begin with. Where abstractness is a concern, consider demonstrating in the specification how a claimed structure or transformation is both specific and central to the claim. In the computer program space, describe example embodiments that that require a computer programmed or configured in a specific manner to flat-out work. Don?t leave room for ?any computer? to perform the method or for anyone to suspect that the method could be performed, even inefficiently, by hand or in one?s mind. (From previous advice example: disclose results of a calculation are useful only in real-time and can only be achieved by computer, coupled with a claim to real-time computer-implemented calculation, or disclose a process that depends on information remotely input or gathered from several sources simultaneously, coupled with a claim reciting a computer specially networked to the various remote sources). Don?t rely on a structural or medium claim, or incidental recitation of ?with a computer,? to save a claim that can be reduced to an abstract idea from ? 101. As seen in Bancorp Services and so many other recent patentable subject matter cases, claim validity arbiters are very much looking at just how much a computer gives life to any type of claim in determining if the claim impermissibly preempts.

Comment: The claims here seem comparable to those in CLS Bank. The CLS Bank majority really zoomed in on the ?shadow debit/credit? terms as evidence of a specific implementation of a settlement that required a computer programmed for handling these shadows. The panel here could have probably similarly focused in on the recited storage of the specialized value types and disclosure of such storage with computers to do the same. But they didn?t, and I?m not completely sure what the stopper was. It may be that claims at issue here had such little step-interactivity and dependency among the various terms; that is, the Bancorp claims do look more like a list of independent calculations of unrelated terms that could be done mentally. I?m also more than willing to admit my deficiencies in Wall Street wizarding knowledge on this one ? I can?t confidently speak as to how involved or specific the recited calculations were beyond typical estate management ideas.

The ?792 patent was subject to challenges in two earlier cases in 2004 and 2008, but only indefiniteness was raised as an invalidity in the prior cases. I think it reflects just how much has changed in the last four years on the ? 101 front. Given the courts? lumping of system, media, and method claims together for ? 101 purposes, I?m pretty sure even State Street?s ?data processing system for managing a financial services configuration? would not be patent eligible these days. A whole slew of issued patents of similar mid-90s to mid-aughts vintage are likely not nearly as valid as they once were.

Two final observations. First, the court disposed of the argument that the claims were not preemptive because of non-infringment. The court dodged this ?clever? argument by saying non-infringment was merely plead as a defense in the alternate. Does this suggest the court might be of a different opinion if the case arrived on appeal with an actual verdict/finding of non-infringement and invalidity? Second, Judge Lourie used claim differentiation to broaden a claim, despite the specification?s disclosure of only the subject matter of the dependent claim (i.e., computer systems) in a fairly limited fashion. This is rare for him. Even though the dependent and system claims ultimately fell, would construing the independent method claim narrowly, as requiring a computer, perhaps admitted that computers were more central to the method for 101 purposes?

Obama's last campaign taking a nostalgic detour

WASHINGTON (AP) ? Barack Obama reminisces about taking a wrong turn and getting lost, about fumbling to fold up a map and about dashing to Kinko's to copy campaign fliers.

The president's re-election campaign is sounding like a nostalgia tour.

His speeches stroll through elections past, serving up fond memories of running as a political unknown. He also reminds voters that, win or lose, this will be his last campaign after 13 appearances on the ballot since 1996.

These are not the casual ad-libs of a candidate suddenly turning wistful. Rather, it's a rhetorical device designed to transport Obama back to the days when he was the kind of ordinary guy voters felt they could relate to, long before he rode in limousines and flew Air Force One.

Philly museum, AyCee casino share 'Identity' | gambler

The main question to be asked about ?Identity?An Exhibition of You,? which is in the midst of a summer-long run at Trump Plaza, isn?t, ?What is it?? Instead, the burning issue is, ?How did the Franklin Institute wind up partnering with an Atlantic City casino??

?Trump Plaza was looking for a family-friendly option for the summer. They asked us what we had, and if there was anything we could travel with,? explained Jackie Jiracitano, who is managing the exhibit for the august repository of scientific thought and deed on the Parkway. ?This exhibit was created exclusively to travel.?

As for the strange-bedfellows aspect of the partnership, Jiracitano agreed it?s an unexpected pairing, but added, ?Identity? is ?a great (way) to bridge the gap? between two such disparate realms as museums and casinos.

?Identity? consists of 25 interactive stations designed to explain the hows, whys and wherefores of human existence. More to the point, the often whimsical applications attempt to portray in non-scientific terms how physical, psychological and social elements combine to forge a human personality.

Although adults will find much of interest, the program is no doubt geared toward kids, who will delight in the numerous special effects provided by kiosks with plenty of buttons to push. Among the most entertaining are the display that allows someone to see what they?d look like if they were a different race and gender, and the one that illustrates what a person would look like if his or her face were 100 percent symmetrical (trust us, it ain?t pretty).

Another station is titled ?How to Make A Baby,? but it?s not what you think. Instead, it?s a lesson on the crapshoot of genetics?how and why siblings often bear little physical or psychological similarities.

?Identity,? which can be found in the Plaza?s East Tower, isn?t particularly dazzling, and the individual displays seem somewhat low-tech in our touch-screen world. But it offers families a heat-beating activity that combines education and entertainment. Perhaps more important, it offers visitors to the beleaguered gambling capital another non-gambling option which, as we are repeatedly reminded, is the name of the game in AyCee these days.

(Just a heads up to everyone, I do plan on making this into a video game. I'm in college and this is a current project I have been working on for a while. I have a lot of information that is not listed and a lot I don't want to use for an RP. Don't worry, your characters will not be included in the actual game[if I ever finish it] and the events will be very different.)

This is a place where you can ask questions about the gemstones and world while making character applications and posting in the actual story. If anything is confusing or you want to check about something, here is the place to do it! First, I'm going to add information that was confusing to some people.

Gemstones are born as gems. They receive Nature's blessing and are unaware unless told of what they are. No one has any way of knowing about gems unless told by Nature or Chaos(and Chaos has to guess) or if a gemstone that had already been told about being a gemstone by the noted sees the signs and tells the gem.

There is only one gem on a gemstones body. It should be in a place that relates to the characters personality or powers.

Planes have begun dropping water on forests in Spain in an attempt to put out two raging wildfires which have killed four people, injured more than 100 and forced thousands of residents to stay indoors.

Dash air tankers are collecting water from a reservoir and using it to fight the fires which have devastated large parts of Catalonia, in the north-east of the country.
A teenage girl and her father died after they jumped into the sea from a 165ft cliff in a desperate attempt to escape the blazes.

Flames forced the French pair, three family members, and about 150 other tourists out of their vehicles as most were returning home.
The group scrambled down hillsides toward the beach in the Costa Brava town of Portbou, said Deputy Mayor Elisabet Cortaba.

The family of five got separated from the rest of the group on their way down and ended up at the cliff edge with no way out as the fire advanced, fanned by heavy winds.

?The fire started to close in on them and they couldn?t climb up or climb down,? the mayor said, after speaking with witnesses. ?The only way out was to jump into the sea.?

The 60-year-old father died instantly after landing on rocks, and his 15-year-old daughter drowned, she said.

The mother was in a critical condition yesterday with a back injury, but the son and other daughter did not suffer life-threatening injuries.
Police said the blaze at Portbou was probably sparked by someone throwing a lit cigarette out of a car along a small road inundated by vehicles heading to France.

Two other people were also killed by the fires, which have burned across 35 square miles, including one man who had a heart attack tackling flames around his home in Llers.
The fires, fanned by strong winds, have caused transport chaos as they swept through parts of Catalonia, forcing the suspension of train services in Alto Ampurdan and the closure of several cross-border roads linking Barcelona with France.

More than 140,000 people in the region have been ordered to remain in their homes and 80 fire crews have been deployed to fight the fires, which appear to have started close to the border with France.

?The situation on the roads of the area is very complicated,? the fire service said in a statement, which added that the main highway linking Spain with France through La Jonquera had been closed.
